Upon submitting your application you will be required to place a $200 deposit to be considered as an adoptee for one of our puppies. Deposits are non-refundable and will be applied to the total purchase price of your puppy.

CONDITIONS OF SALE
Seller guarantees that at the time of delivery, the dog was check by a licensed Vet and is in good health. Should dog be found to be in poor health of a serious nature that is diagnosed as permanently life altering by a veterinarian, Seller will provide Buyer with a replacement dog from another litter after dog is returned to seller at Buyer's expense, or a full refund of the purchase price of dog only after dog is returned to Seller at Buyer's expense.
Shipping & Prep School fees will not be refunded.
The following conditions apply to the sale of the aforementioned dog only: The Buyer has THREE (3) days from the time of receipt of dog to have dog examined by a veterinarian. Any request to return the dog to the Seller for a full refund must be made within this time period and may only be requested should the dog be found to have a health issue of such serious nature that the quality of life of the dog will be shortened or seriously altered.
Minor health ailments including, but not limited to, fleas, worms, or stress induced diarrhea due to the puppy's transition from the Sellers home are not reason for dog to be returned to Seller.
Proof of examination and diagnosis must be provided to Seller and Sellers vet, should Buyer wish to request returning dog for a refund.
Proof of a pre-existing ailment or condition that requires minor treatment and will not alter or shorten the dogs life will be reason for Seller to reimburse Buyer for the expenses associated with treating that ailment or condition.
We do strive to produce a certain look & coat type, but we do not guarantee size, color, or appearance, shedding, hypo-allergenic, or coat types.
This warranty will be terminated immediately if dog is not examined within the allotted time.
A warranty against all serious life altering genetic disease is provided for two years after the date of sale. Should a genetic disease be discovered during this time that will greatly shorten the life of, or greatly alter the quality of life of dog, Seller will reimburse Buyer the veterinary costs up to the purchase price of the dog, if dog is kept by Buyer, OR provide a replacement puppy to Buyer from a similar litter type from first litter with availability.
Two independent veterinary examinations and reviews must be provided to Seller documenting the genetic health issue. Reimbursement of veterinary fees is provided to Buyer once copies of the medical reports are received by Seller.
Reports must state the treatments provided, and fees for the treatments.
A warranty for HD (hip dysplasia) is provided for two years after the date of sale. This warranty will be terminated should dog be allowed to become overweight or developing joints be overstressed at any point during the warranty period. Veterinary medical records will be required showing the weight of dog and veterinarians assessment of the weight. Should dog be found to have HD within its first two years, Buyer must provide Seller with proof in the form of documentation from PennHIP.
We reserve the right to confirm the results before a replacement or refund is provided. Should results from PennHIP indicate that an injury may have occurred that caused or contributed to the issue, no reimbursement or replacement will be provided.
Warranties shall apply only to original purchaser. Transfer of dog ownership shall void all such provisions of this agreement. Buyer agrees to first contact Seller should it ever become necessary to re-home dog. Seller will assist in re homing the dog, an. Buyer agrees to never relinquish the dog to an animal shelter, rescue organization or puppy mill. Under no circumstances shall the Seller be liable to the Buyer or to any third party for any consequential incidental or special damages resulting from or in manner related to the dog. Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the buyer.
Maintainence
Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculations and internal and external parasite treatments for fleas, tick & heartworms. Veterinary records must be provided to breeder if requesting refund or replacement. If any of the above preventative care has not been provided, health warranty will be void. Buyer also agrees to provide, at minimum, basic obedience training for dog.
Temperament
Although Schnoodles are known to have wonderful temperament; temperament cannot be guaranteed.
Buyer understands that all puppies exhibit certain undesirable behaviors (nipping, chewing, barking, marking, etc). Buyer is responsible for appropriate training of puppy to correctly teach acceptable behaviors, and is responsible for proper socialization of puppy. Should Buyer not be successful at training these behaviors on their own, Buyer agrees to seek professional help from a certified trainer should it become necessary.
If buyer chooses not to send their puppy to our Doodle Prep School Program, Seller will not be responsible for puppy's temperament once the puppy has left the kennel.
If the buyer chooses to send their puppy to our Doodle Prep School Program, the Seller and trainer will be involved in the at home training process as much as possible. Buyer understands that they will go by the training methods and guidlines that their puppy was trained to at Doodle Prep School, and agrees to find a trainer in their area that have the same or simular training methods and guidlines to continue the training if neccessary at buyers expense.
We require that you have your puppy spayed or neutered within the first 7 months of their birth date. Failure to do so or to provide documentation to this affect by the age of 12 months will void the health guarantee and could possibly result in legal proceedings.
Deviations from this stipulation can and may be pursued by Smeraglia Kennel through an attorney as a breech of contract.
If there is ever a dispute between Seller and Buyer all suits will be handled in the state of Alabama.
The parties agree that this writing represents the entire Agreement between them and that no other representations have been
made regarding the dog described above. I agree to the items listed in the conditions of sale.
